1. Our approach

Selectvia hosts catalogues created by independent sellers and acts as an intermediary under Section 79 of the Information Technology Act, 2000. We remove or disable access to infringing content when we receive actual knowledge of it, as required by the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and in line with the Copyright Act, 1957 and the Trade Marks Act, 1999.

2. Reporting infringement

Send a notice to grievance@selectvia.com including:

  • Your name, address, phone number and email, and if you act for the rights holder, your authority to do so.
  • A description of the trademark, copyright or other right being infringed, with registration numbers where available.
  • The exact Selectvia URL(s) of the catalogue or product concerned.
  • Why the content infringes your rights (for example counterfeit goods, unauthorised use of photos or logos).
  • A statement that you believe in good faith the use is not authorised, and that the information in your notice is accurate.
  • Your physical or electronic signature.

3. What happens next

  • We acknowledge notices within 24 hours.
  • If the notice is complete and valid, we remove or disable the content within 36 hours and notify the seller with a copy of the notice (your contact details may be shared so the matter can be resolved).
  • Incomplete or clearly unfounded notices may be rejected; we'll tell you why.
  • Court orders and directions from government agencies are complied with within the time required by law.

4. Counter-notices

If you are a seller and believe your content was removed by mistake or that you have the right to use it, reply to grievance@selectvia.com within 14 days with your details, the removed URL, your reasons and supporting evidence (for example a distributor agreement or licence). We may forward it to the complainant and restore the content if the complainant doesn't show us that they have started legal proceedings within 10 working days.

5. Repeat infringers

We terminate the accounts of sellers who are the subject of repeated valid infringement notices.

6. Misuse of this process

Knowingly false notices or counter-notices can create legal liability. We may ignore notices from people who repeatedly misuse this process.
